The program is administered by the Texas Department of Housing and Community Affairs (TDHCA) with funding provided by the Homeowner Assistance Fund under the American Rescue Plan Act of 2021.

In Texas, an oral or written rental agreement is considered as valid when a landlord accepts regular payments for inhabiting a property. According to Texas law, a rental agreement allows certain rights to the tenant, such as the right to a habitable dwelling and the right to take at least one form of alternative action.

Landlords also have certain rights, such as the right to collect rent on a regular basis and deduct for costs from damages that are beyond normal wear and tear. .
